Terms and Conditions
1. Legal Introduction
These Terms and Conditions ("Terms") govern all motorcycle maintenance, restoration, engineering, and diagnostic services ("Services") provided by All Eras MX Resurrections LLC ("the Shop," "AEMX," "we," "our," or "us"). By delivering a motorcycle for service or commissioning a project, the client ("you" or "the Customer") acknowledges and accepts these Terms in full.
2. Range of Services
All Eras MX Resurrections LLC specializes in the full-scale restoration, repair, performance tuning, and custom fabrication of motorcycles from every era. The specific scope of work for each project will be outlined in a formal written estimate or work order authorized by the Customer. We reserve the absolute right to refuse any projects deemed mechanically unsafe, physically impractical, or beyond our current technical specializations. Any unforeseen mechanical needs discovered during the service process will require explicit Customer authorization before additional work is executed.
3. Financial Estimates, Deposits & Payment Procedures
Project estimates are professional approximations and do not constitute a fixed final price guarantee. Financial deposits are required for parts procurement, specialty sourcing, or high-budget restoration projects. Final balances must be cleared in full upon project completion and prior to the release of the motorcycle. Any remaining deposit credits will be issued to the Customer upon the successful conclusion or authorized termination of a project.
4. Component Procurement and Lead Times
a) Shop-Sourced Components
All Eras MX Resurrections LLC utilizes both OEM and high-quality aftermarket components based on technical requirements and Customer input. Vintage, legacy, or discontinued parts can be challenging to locate and may require extensive refurbishment. These external factors can significantly impact restoration timelines; therefore, AEMX is not liable for delays caused by global parts scarcity or shipping logistics. Refurbished or vintage components are provided without warranty unless documented otherwise. The Customer accepts all inherent risks related to the age and manufacturing limitations of these specialized parts.
b) Customer-Provided Components
All parts supplied by the Customer must be verified for compatibility and structural integrity. The use of incorrect, damaged, or poor-quality parts will delay the project, and AEMX assumes no responsibility for these setbacks. All Eras MX Resurrections LLC disclaims all liability for mechanical failures, performance drops, or additional labor costs arising from the installation of customer-supplied parts. The Customer assumes all risks related to these items.
5. Professional Workmanship Warranty
All Eras MX Resurrections LLC provides a 30-day warranty on labor and shop workmanship starting from the date of vehicle pickup. Exceptions to this warranty include: use of the motorcycle in racing, stunts, or competitive events; physical abuse, operational neglect, or lack of proper engine maintenance; failures occurring in mechanical systems not serviced by the Shop; issues resulting from any Customer-supplied parts; and standard wear-and-tear components. All warranty claims must undergo a physical inspection at our facility before any remedial work is authorized.
6. Operational Risks & Liability Waiver
6.1 Assumption of Risk
The Customer acknowledges that operating motorcycles—specifically vintage machines in off-road or high-performance environments—involves significant danger, including mechanical failure, loss of control, severe injury, or death. The Customer voluntarily assumes all such risks upon taking delivery of the vehicle.
6.2 Release of Liability
Upon take-over of the motorcycle, the Customer formally releases All Eras MX Resurrections LLC from all liability regarding injuries, property damage, or financial loss stemming from the use or performance of the bike. This includes alleged mechanical failures or parts issues, except in instances of proven gross negligence or intentional misconduct.
6.3 Safety Responsibilities
The Customer agrees to: perform a comprehensive safety inspection before every ride; cease operation immediately if unexpected noises, vibrations, or handling changes occur; and assume all legal and physical risks for continuing operation after identifying potential issues.
6.4 Safety Disclaimer
We do not guarantee that any restoration or repair will eliminate the possibility of future mechanical failure or ensure absolute safety under extreme riding conditions.
7. Legal Indemnification
The Customer agrees to indemnify and hold harmless All Eras MX Resurrections LLC and its personnel from any legal claims or expenses arising from the Customer’s use of the motorcycle post-service, excluding cases of our proven gross negligence.
8. Storage and Vehicle Abandonment
Daily storage fees may accrue if a vehicle is not retrieved within 7 days of the completion notice. Motorcycles left unclaimed for more than 30 days without active communication are legally considered abandoned. The Shop reserves the right to sell or dispose of abandoned property to satisfy outstanding service balances.
9. Authorization for Testing
The Customer grants AEMX full permission to test ride, tune, and operate the vehicle on or off-site as required to ensure service quality.
10. Digital Media Rights
The Customer permits All Eras MX Resurrections LLC to photograph or film the motorcycle for use in marketing, social media, and professional portfolios, unless a written opt-out is requested.
11. Maximum Liability Limit
To the extent permitted by law, the total financial liability of the Shop for any claim shall never exceed the total amount paid by the Customer for the specific service in question.
12. Governing Jurisdiction
These terms and all service agreements are governed by and construed in accordance with the laws of the State of Colorado.
13. Agreement Acknowledgment
Submitting a motorcycle for service, approving a project quote, or providing a deposit constitutes full legal acceptance of these Terms and Conditions.
