Customer Liability Waiver & Release of Claims

Standalone Liability Waiver & Release of Claims

This Standalone Liability Waiver & Release of Claims ("Waiver") is executed by the undersigned Customer ("Customer") in favor of All Eras MX Resurrections, its owners, employees, agents, contractors, and affiliates (collectively, "the Shop"). This Waiver applies to all motorcycle repair, restoration, modification, tuning, diagnostic, and related services performed by the Shop.

1. Acknowledgment of Inherent Risks

The Customer acknowledges that operating a motorcycle-especially off-road, in competition, or under high-stress conditions-carries inherent and unavoidable risks, including but not limited to:

  • Mechanical failure

  • Loss of control

  • Crashes or collisions

  • Serious injury or death

The Customer understands and accepts that these risks exist regardless of the quality of repairs or workmanship performed by the Shop.

2. Assumption of Risk

The Customer voluntarily assumes full responsibility for all risks associated with operating the motorcycle after it leaves the Shop, including risks arising from:

  • Workmanship

  • Installed parts

  • Customer-supplied components

  • Pre-existing or hidden defects

  • Normal wear and tear

  • Racing, jumping, or aggressive riding

3. Release of Liability

To the fullest extent permitted by Colorado law, the Customer hereby releases, waives, and forever discharges the Shop from any and all claims, demands, causes of action, damages, or losses arising from:

  • Injuries to the Customer or others

  • Property damage

  • Mechanical failure

  • Alleged improper repair, restoration, or workmanship

  • Failure of parts, components, or systems

This release applies even if the alleged issue is claimed to be caused by the Shop’s work, except in cases of gross negligence or willful misconduct.

4. Customer Responsibilities

The Customer agrees to:

  • Inspect the motorcycle before each ride

  • Stop riding immediately if unusual noises, vibrations, leaks, or handling issues occur

  • Perform regular maintenance and safety checks

  • Accept all risks associated with continued operation after warning signs

5. No Guarantee of Safety

The Shop does not guarantee that any repair, restoration, or modification will:

  • Prevent future mechanical failure

  • Ensure safe operation under all conditions

  • Withstand racing, jumping, or extreme use

Motorcycles-especially older or heavily used ones-can fail without warning.

6. Indemnification

The Customer agrees to indemnify and hold harmless the Shop from any claims, lawsuits, damages, or expenses brought by third parties arising from the Customer’s operation of the motorcycle after service.

7. Test Riding Authorization

The Customer authorizes the Shop to test ride, tune, or operate the motorcycle as needed to complete the requested services.

8. Binding Effect

This Waiver is binding upon the Customer and their heirs, executors, administrators, and assigns. If any portion of this Waiver is found unenforceable, the remaining sections shall remain in full force.

9. Governing Law

This Waiver is governed by the laws of the State of Colorado.
